These Terms of Service (“Terms”) govern your use of matthewrscott.com (the “Site”), including our free tools, free guide, newsletter and products, operated by Matthew R Scott Pty Ltd (ABN 70 691 105 861) (“we”, “us” or “our”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

The free tools

We offer free tools such as the Margin Calculator, ABA File Converter, PDF Fill, Pallet Calculator and Stand / Sit Timer. These tools run in your browser and are provided for general information and convenience only.

• They are provided on an “as is” and “as available” basis, and are not financial, accounting, banking, tax, legal or other professional advice.
• You are responsible for checking the results before you rely on them. For example, always verify a generated ABA file and a calculated margin against your own records and your bank’s requirements before acting on them.
• Because the tools run on your device, you are responsible for the files and data you use with them and for keeping your own copies.

The free guide and newsletter

When you opt in, we send you the free guide and, if you choose, our newsletter. You can unsubscribe at any time using the link in any email. Our content is general in nature and does not take account of your specific circumstances.

Paid products

Some products, such as Draft Order Sync, are paid and may be offered on a subscription basis. Pricing is shown on the relevant product page. Payments are processed securely by Stripe, and by purchasing you also agree to any product-specific terms presented at checkout. You can cancel a subscription at any time, and cancellation takes effect at the end of the current billing period unless stated otherwise.

The Escape Velocity program

Escape Velocity is our paid education program. Access is by application and is subject to a separate program agreement provided when you enrol. Nothing on this Site is a guarantee of any particular business result; outcomes depend on many factors, including your own effort and circumstances.

Intellectual property

The Site and its content, including text, guides, designs, illustrations and the tools themselves, are owned by or licensed to us and are protected by law. You may use them for your own personal and business use. You may not copy, resell, republish or redistribute our content or tools, or remove any branding, without our written permission.

Acceptable use

You agree not to:

• use the Site or tools for any unlawful purpose;
• attempt to disrupt, attack, reverse engineer or gain unauthorised access to the Site;
• misuse the tools to process data you do not have the right to use; or
• copy or scrape the Site to build a competing product.

Your consumer rights

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss or damage. Nothing in these Terms limits any right you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

Disclaimer and limitation of liability

To the maximum extent permitted by law, and subject to your consumer rights above, we are not liable for any loss or damage arising from your use of, or reliance on, the Site, the free tools or our free content, including any errors in results or any interruption to the Site. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant goods or services or paying the cost of doing so.

Third-party links

The Site may link to third-party websites and services. We are not responsible for their content, products or privacy practices, and a link does not mean we endorse them.

Privacy

Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page with the “last updated” date above. Continuing to use the Site after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
